Terms of sale
These General Conditions of Sale govern all transactions carried out as a natural person on the site pandester.fr with PANDESTER, SAS registered in the Trade Register under number 949 104 988.
These conditions apply to all orders placed on the pandester.fr website. Before finalizing an order, the Customer must read the conditions of sale set out on the site and accept them without reservation. PANDESTER reserves the right to modify these conditions at any time, but only the conditions in force at the time of the order will be applicable.
1) Availability of Products
All products offered on pandester.fr comply with current French legislation. The information provided on each product sheet is indicative and PANDESTER declines all responsibility in the event of a minor error.
2) Customer Obligations
The Customer undertakes to provide PANDESTER with all necessary and accurate information to process their order, including their last name, first name, address, telephone number and valid email address.
The Client is responsible for the consequences resulting from the communication of false or inaccurate information, as well as any illicit use thereof.
Once the order has been placed, PANDESTER sends the Customer a confirmation email, informing them of the shipment of the products.
3) Order Confirmation
The data recorded by PANDESTER constitutes proof of the transaction. Contractual information is confirmed by e-mail at the time of delivery. The Customer is recommended to keep a record of the information relating to their order. 4) Proof of Transaction PANDESTER's computerized registers are proof of the transactions. 5) Price
The prices displayed on pandester.fr are in euros and include VAT, excluding shipping costs. PANDESTER reserves the right to modify its prices at any time, but the prices in effect at the time of the order will be applied.
6) Payment Method
The Customer pays for the items by credit card (Visa, Mastercard). PANDESTER reserves the right to refuse any order in the event of a previous payment dispute. If a customer transfers ownership of a good purchased from PANDESTER to a third party, only the initial buyer of this good can benefit from the provisions of these general conditions of sale.
7) Delivery
Delivery costs in Metropolitan France are specified on the site. The products are shipped to the address indicated by the Customer when ordering. Delivery is deemed to have been made upon delivery of the product to the carrier.
Delivery cannot be made to hotel addresses or post office boxes.
Delivery is considered completed as soon as the product is handed over to the carrier.
It is the customer's responsibility to verify the accuracy and completeness of the information they provide to PANDESTER. In the event of possible entry errors, PANDESTER declines all responsibility for any delays or delivery errors that may result. In this case, all costs incurred for reshipping the order will be the responsibility of the customer.
PANDESTER cannot be held responsible for delivery delays due to errors or disruptions attributable to carriers (in particular total or partial strikes of postal services and means of transport and/or communication).
8) Delivery Problems
In the event of a delivery problem, the Customer must inform PANDESTER within the allotted time and follow the procedure described on the site.
In the event of a problem related to the carrier, the consumer is required to check the condition of the packaging and the goods upon delivery. Any anomaly observed (damage, item missing from the delivery note, damaged package, damaged items, etc.) must be reported using the Contact Form.
If the shipment is made by La Poste and the package arrives open or damaged, it is imperative that the customer has a "report of theft" (report 170) established by the postman or the Post office on which he depends, so that PANDESTER can open an investigation and initiate a compensation procedure.
The customer must then confirm this anomaly by sending, within 2 working days following the delivery date, a registered letter with acknowledgment of receipt to the carrier, detailing the theft claims. A copy of this letter (with a copy of the report of spoliation, if applicable) must be sent simultaneously by email to: virsancreative@gmail.com.
Any complaint received outside this deadline will be rejected.
In the event of an error in the preparation of the order or a non-compliant product, the customer must formulate his complaint in detail to PANDESTER on the same day of delivery or at the latest on the first working day following delivery. This complaint can be sent through the Contact Form, mentioning the order number: Contact Form.
Any complaint which does not respect these rules and deadlines cannot be taken into account and will release PANDESTER from any liability towards the consumer. After receiving the complaint, PANDESTER will send a confirmation email to the customer to confirm that the return is being processed.
The return of a product can only take place after receipt of this confirmation email and following the procedure presented above. Any product to be refunded must be returned within 14 working days following receipt of PANDESTER's return agreement, with the order reference. The product must be returned in its original packaging in perfect condition (unused, unwashed) with the label uncut, to the following address communicated by PANDESTER Customer Service following the complaint made by email.
Failure to comply with this procedure will result in the rejection of any claim for non-compliance or apparent defect of the products delivered.
9) Intellectual Property
PANDESTER holds the intellectual property rights of the site and is authorized to distribute the elements of the e-shop catalog, in particular the photographs, for which it has obtained the necessary authorizations. According to the provisions of the Intellectual Property Code, it is strictly prohibited to reproduce, in whole or in part, the elements of the site and the catalog, to use them or to make them available to third parties on any medium whatsoever, under penalty of prosecution.
10) Liability & Disputes
The images and texts illustrating the products presented are not contractual. Consequently, PANDESTER cannot be held responsible for minor errors in these illustrations or texts. PANDESTER cannot be held liable for any material, immaterial or bodily damage resulting from inappropriate use of the products sold, or from modifications made by suppliers.
In all circumstances, PANDESTER's liability is limited to the amount of the order, and it cannot be held responsible for simple errors or omissions despite all the precautions taken during the presentation of the products.
PANDESTER reserves the right to cancel an order in the event of a computer bug, hacking, entry error or any other malice internal or external to the company. If such a cancellation occurs, PANDESTER undertakes to contact the customer to inform them. PANDESTER cannot be held liable to the customer or any third party for any indirect damage, even if it was foreseeable or brought to the attention of PANDESTER.
PANDESTER's liability is capped at the amount paid or payable in the transaction giving rise to the liability, regardless of the type of claim or action.
PANDESTER declines all responsibility in the event of non-performance of the contract due to stock shortages, unavailability of products, force majeure, disruptions or strikes affecting postal services, means of transport or communication, or in the event of events such as floods, fires, earthquakes or lightning.
In the event of a dispute, the customer must first contact PANDESTER to find an amicable solution. The general conditions of sale are subject to French law and any dispute will be under the exclusive jurisdiction of the French courts.
11) Information & Personal Data
PANDESTER undertakes not to disclose to third parties the confidential information and data communicated by customers on the site. The information entered by the customer will only be used for processing orders and to personalize communication by newsletters as well as the display of certain offers on the site.

12) Modification of the General Conditions of Sale
The General Conditions of Sale are applicable to all transactions carried out online on the site, as long as it is accessible on the internet. They are precisely dated and can be modified and updated by PANDESTER at any time. The General Conditions in force at the time of the order are those which apply. Changes to the General Conditions do not affect items already purchased.
No modification of the legislation or regulations in force, nor any decision of a competent court invalidating one or more clauses of these General Conditions calls into question their validity. These changes or decisions in no way exempt customers from respecting the General Conditions.
Any aspect not explicitly addressed in these conditions will be regulated in accordance with the practices of the retail sector, for companies whose head office is in France.
The General Terms and Conditions may be modified by PANDESTER at any time, but the conditions in force at the time of the order will be applied.
These General Conditions of Sale are governed by French law and any dispute falls under the jurisdiction of the French courts.
